Controversial tech CEO Elon Musk may have broken anti-bribery laws with his $1 million offers to voters, a state election commission says. ​

Musk first gave $1 million a day to supposedly random voters during the 2024 Presidential Campaign, in exchange for signing an America PAC petition. Each day until the election, one signatory was handed a million-dollar prize, although Musk’s team has since admitted that those given the award were not chosen at random. ​

However, probable cause was found that Musk broke state law – which makes it a crime to offer something of value in order to induce a person to vote – in relation to the 2025 Wisconsin Supreme Court election. The SpaceX founder handed out $1 million checks at a rally shortly before the election.

​Complaints against Musk were brought by voters in Milwaukee and Green Bay in Brown County. ​

On Thursday, the Wisconsin Elections Commission voted 5-1 in a closed session to refer two complaints to the district attorney, commission spokesperson Emilee Miklas told The Associated Press. The commission is composed of three Democrats and three Republicans. ​

The Brown County District Attorney’s office can choose to bring criminal charges against Musk over violating the state law against election bribery, but prosecutors only have 40 days in which to report back to the commission. ​

The Commission said that it found probable cause that Musk broke state law by uploading a social media post in which he offered $1 million to people who voted in the election.​

Three people were handed $1 million checks by Musk, with two receiving them at a Green Bay rally. The two voters who received their checks in person were described as spokespeople for Musk’s America PAC.​

Josh Kaul, Wisconsin’s Democratic Attorney General, tried to prevent Musk from giving the checks to voters, but the attempt was rejected by state courts. ​

Musk’s legal team said that their client was exercising his right to free speech and that attempts to prevent him from doing so would violate the state and the U.S. Constitution, according to The Associated Press.​

Musk also offered $100 to voters who signed a petition expressing opposition to so-called “activist judges” or referred someone to sign it. The offer was made two weeks before the election via America PAC.

​Musk, and groups affiliated with him, spent about $20 million while backing Brad Schimel, the Republican-backed candidate, during the state’s Supreme Court election. Despite that effort, the Democratic-backed candidate Susan M. Crawford ended up winning the election by 10 percentage points.

Following the Wisconsin Supreme Court election, an advocacy group sued both Musk and America PAC in a state court, alleging that the giveaway had created an unauthorized lottery and violated the state’s election bribery statutes. Musk’s team has sought to dismiss the suit, which remains pending.

The Independent has contacted SpaceX and the Wisconsin Elections Commission for comment.
