The allegation puts automated player targeting in the spotlight, but Maine has not announced a formal investigation or found wrongdoing. For a company whose platform strategy and expansion have made it a major name in sports betting, scrutiny over how promotions reach customers is a player-protection issue, not just a marketing footnote.

What “elasticity” means in this dispute

The Times report, citing former DraftKings employees, said the company used AI to identify customers more likely to keep wagering after receiving promotional offers. The primary report describes “elasticity” as the company’s term for players who might be encouraged to spend more and use the platform longer.

That account remains contested. DraftKings said the Times’ reporting relied on former employees and rejected the suggestion that its tools targeted people based on losses or signs of problem gambling. A West Virginia-based gambler has also filed a federal lawsuit in Massachusetts and is seeking class-action status, while Massachusetts regulators have opened an investigation into the company.

Maine is watching, not announcing enforcement

Maine’s Gambling Control Unit said it is monitoring AI use locally and nationally, but that the state has no laws or rules specifically addressing its use. The distinction matters: monitoring is not a formal finding that DraftKings broke a rule, and the primary report says Maine has not formally characterized the company’s conduct.

Scrutiny is also growing elsewhere. The primary report says Maryland’s governor has called for an end to practices using “algorithmic and other means” to target users likely to spend more. That does not establish that DraftKings’ alleged practices violated the law; it does show regulators are examining how automated systems shape sportsbook promotions.

The player-protection question behind the promos

The Maine unit’s statement is the clearest guide to the state’s current position: “The Gambling Control Unit is monitoring the use of AI locally and nationally, but at this point there are no Maine laws or rules specifically addressing its use.” DraftKings, meanwhile, said it “does not use AI to target anyone based on losses and does not market to customers based on indicators of potential problem gaming.”

AI can be discussed as a way to improve consumer protection, but the same tools can also influence who receives bonuses and how operators try to retain customers. For bettors, the practical concern is whether personal data and betting behavior are being used to deliver relevant offers-or to keep someone wagering longer than they otherwise would. The allegations have not been proven, but the question deserves more than a terms-and-conditions footnote.

That broader tension sits alongside the data collection built into betting platforms. How operators handle customer information is part of the same player-protection conversation as sportsbook data security.
