If you are a British esports fan who has spent the last two years illegally fiddling with VPN locations just to trade on Polymarket or Kalshi, your daily headaches might soon come to an end.

The Financial Conduct Authority is officially weighing up changes to UK regulations that could legalize prediction market platforms across the country.

According to a report by The Times, regulators are noticing that outright bans do not actually stop people from trading, they just push everyone into the digital wilderness.

The VPN Problem and the FCA’s Awakening

Right now, prediction platforms that rely on “yes or no” binary options are strictly banned in the UK thanks to a rule introduced back in 2019. The FCA originally put the ban in place to stop retail investors from accidentally setting their life savings on fire over high-risk financial instruments.

The issue, of course, is that internet users are stubborn. British esports fans have been using virtual private networks in droves to buy and sell event contracts on major League of Legends matches, CS2 majors, and Valorant tournaments.

An industry insider noted to The Times that regulators are realizing their prohibitions are largely ineffective, and actively driving consumers to offshore operators with zero regulatory standards at all.

The Gambling License Catch

Before you start planning to turn your League of Legends match predictions into a full-time career, there is a pretty massive regulatory hurdle standing in the way.

While the FCA might relax its stance on binary options trading, esports and sports prediction markets will almost certainly be classified under gambling law. That means platforms like Kalshi and Polymarket would need to apply for official licenses with the UK Gambling Commission.

That creates a funny dilemma for these giant US platforms. They have spent years fighting tooth and nail in American courts to prove they are legal financial exchanges rather than sportsbooks. If they turn around and sign up for a UK gambling license, American lawyers will immediately use that as evidence against them in US courtrooms.

Big Volume and League of Legends Dominance

Despite all the legal gymnastics happening behind the scenes, the demand for esports prediction markets is absolutely surging. Data shows that League of Legends matches alone average over $1.2 million in trading volume on these platforms, with Counter-Strike 2 pulling in nearly $1 million per major event.

Whether prediction platforms bite the bullet and apply for UK licenses remains to be seen. But one thing is clear: the era of pretending binary prediction markets do not exist is officially over, and British esports fans might finally get a legal piece of the action.
