Stake has won a temporary legal route back into Brazil, with a São Paulo federal court authorising the betting platform to operate through October 25 and ordering its website unblocked. The partial injunction is the first court victory for a licensed fixed-odds betting operator in the challenge to Brazil’s shutdown, but it is a narrow exception, not a reversal of the wider prohibition.
For esports betting fans, the distinction matters: a court has restored access to one licensed platform, but has not settled whether the market can keep operating. President Luiz Inácio Lula da Silva introduced the shutdown through Provisional Measure 1.394, and Stake’s lawsuit sought permission to continue until December 31, 2029, when its operator licence expires. The court granted only the shorter window.
A temporary opening, with strict limits
Federal Judge Cristiane Farias Rodrigues dos Santos, of São Paulo’s 9th Federal Civil Court, signed the decision. The case was brought by law firm Bichara e Motta. The order directs authorities not to treat Stake’s authorisation as terminated during the permitted period and suspends blocking of its platform.
The court attached 12 conditions to the reprieve. Stake must maintain bettor identification, allow customers to withdraw balances, preserve enough funds to cover outstanding balances, and keep registration, financial and transaction records. It must also continue regulatory reporting and fraud-prevention measures, while preventing legally barred people from betting and blocking the use of money from social programmes.
The restrictions also prohibit advertising directed at children and teenagers, new promotions intended to grow the user base, and operation through unauthorised domains. The ruling cannot be used to legitimise clandestine operators or others misusing the Stake brand. That enforcement angle is familiar in a shutdown where access to unauthorised betting domains is part of the broader regulatory problem.
One operator’s win does not settle the fight
Before Stake secured relief, two of Brazil’s main gambling trade bodies asked the Supreme Federal Court to overturn Lula’s measure. The timing of a ruling on that wider challenge was unclear in the reporting from iGaming Business and TokenPost. Stake’s court order addresses its own access; it does not invalidate the national measure.
Bichara e Motta described the decision as the first favourable ruling for a fixed-odds operator in the dispute, while stressing that Stake’s request to operate until its licence’s original expiry still needs a decision on the merits. In legal terms, that review is the main match still to be played: the short injunction has bought time, not a final win.
October 25 is the next checkpoint
Stake’s authorised operating period runs through October 25. Whether the company can retain access beyond that date depends on the unresolved merits review, while the broader challenge to Provisional Measure 1.394 also remains unsettled in the available reporting.
Brazil’s shutdown has already created uncertainty for licensed betting platforms; Stake’s reprieve adds a concrete court test, but not a green light for the rest of the market. The legal challenge to Brazil’s betting shutdown now has its first operator-level win, with the bigger question still open: whether that foothold survives beyond the temporary order.
