Disney, Warner Bros., and Universal may have to disclose their AI practices amid a court battle. The dispute stems from copyright litigation between the three major studios and AI image generator Midjourney.
Why Midjourney wants Hollywood to disclose their AI practices
According to Variety, in June, a judge allowed Midjourney to obtain information from the studios about how they use AI. Under the ruling, the studios would have to provide information about “consumer-facing” AI tools.
However, the generative AI platform has recently filed an appeal, urging Judge John Kronstadt to overturn the decision, because according to them, the studios should reveal more about their AI use.
Midjourney’s attorney, Bobby Ghajar, wrote, “If Plaintiffs are developing image-generating AI models — trained on unlicensed, third-party copyrighted data — for internal use in storyboarding or ideating content for film or TV, that evidence would equally demonstrate that it is an industry custom, even among the studios themselves, to download and train AI on unlicensed copyrighted content.”
They seek information on the studios’ AI business plans, research reports, model weights, training datasets, board meetings related to AI, and other data on how they use AI to create and market movies and TV shows.
More than a year ago, Disney and Universal filed a lawsuit against the generative AI platform Midjourney, which was then followed by Warner Bros., which later filed a separate lawsuit. The lawsuits allege copyright infringement, as the Studios accused the platform of training its AI to generate copyrighted images without seeking permission.
This allowed its users to generate images in the art style of the studios. Despite being asked to stop by the studios, Midjourney refused, which resulted in this lawsuit. The AI image lab’s argument for infringement was “fair use.” They also accused the studios of using the same practices, as Ghajar stated, “If Plaintiffs are doing the very thing they seek to punish, that evidence goes to the heart of Midjourney’s fair use and unclean hands defenses.”
Although the studios are ready to show their data on “consumer-facing” AI tools, they are unwilling to disclose internal information. Moreover, in June, the magistrate judge denied the AI generator’s attempt to obtain the broad information they seek related to the Studios’ AI use, as the judge found it irrelevant to the copyright infringement case.
